Pharmaceutical Company Files Second Lawsuit Against 'Pittsburgh Post-Gazette'

NEW YORK A pharmaceutical company that had sued the Pittsburgh Post-Gazette in August claiming it wrongfully obtained an internal memo for a July article about the firm, has filed a second suit against the newspaper, according to The Wall Street Journal.
Mylan Pharmaceuticals Inc. of Canonsburg, Pa., on Friday filed a defamation lawsuit against the Post-Gazette that accused the newspaper of "mischaracterizing its actions" in the July article.
"In the lawsuit, filed in Circuit Court of Monongalia County, W. Va., Mylan said the Post-Gazette and its staff writers 'intentionally and misleadingly omitted, juxtaposed and distorted the facts' in an article," the Journal reported, adding the Post-Gazette story said "Mylan workers had routinely violated quality control procedures at the company's generic drug manufacturing plant in Morgantown, W. Va."
It added that The U.S. Food and Drug Administration investigated Mylan after the article appeared and did not find any "objectionable" deficiencies or evidence that the company's products had been compromised, the Journal reported.
Post-Gazette officials declined to comment to the Journal on the lawsuit, which states Mylan is seeking unspecified compensatory and punitive damages.
In August, Mylan filed a suit that accused the Post-Gazette of wrongly obtaining trade secrets, including an internal memo. The newspaper has called the allegations "meritless."
