Conn. Paper Drops Delivery Tubes Suit

By: Mark Fitzgerald

The Day of New London, Conn., has dropped the federal lawsuit it filed against its hometown last April over the removal of 120 newspaper-delivery tubes installed between sidewalks and streets in front of subscriber homes.

The Day said it still believed it had a constitutional right to distribute newspapers on the city right of way, but did not want to pursue litigation that could go on for years.

New London’s city council ordered the removal of the tubes in March 2001, saying they were eyesores.
