The state Court of Appeals has ruled in favor of a Farmington newspaper and an open-government group in a legal dispute with the city over open records.
The Daily Times and the New Mexico Foundation for Open Government sued the city of Farmington two years ago in an effort to find out who had applied for the city manager’s position.
The city had argued that the applications were not public record and that releasing them would hinder the hiring process.
A state district judge ruled in 2007 that the applications should be turned over to the newspaper.
The state Court of Appeals affirmed that on Thursday, saying that the public’s interest in disclosure outweighs the city’s concern about the applicant pool.
