Libel Case Against Sioux Falls, S.D. ‘Argus Leader’ Will Go to Trial


The South Dakota Supreme Court refused to dismiss a libel lawsuit against the Sioux Falls Argus Leader and its top editor over a column he wrote, so the case will proceed to trial.

Former Sioux Falls Development Foundation President Dan Scott sued the newspaper for at least $1 million.

Scott says his reputation was damaged by a column last summer from Executive Editor Randell Beck about a speech Scott made in which he chided the Argus Leader and asked lawmakers not to hinder Sioux Falls’ growth.

Beck says it was clearly satire and protected by the First Amendment.

The lawyer representing him and the newspaper asked for an intermediate appeal with the state Supreme Court, but justices said the case should proceed.
