By: E&P Staff An Ohio appeals court has awarded the Akron Beacon Journal $13,233 in attorneys fees in its public records lawsuit against the city and chief of police of Akron, the Knight Ridder paper reported today.
The 9th District Court of Appeals ruled the paper was entitled to some fees spent in its lawsuit to force release of the records of two incidents, one involving the rape of a 14-year-old girl and the other a police internal affairs investigation into the alleged assault of a 15-year-old boy by two police officers.
In its ruling, the court set the Beacon Journal's compensation at $17,631 for its in-house counsel and another $931 for fees paid to outside counsel. At the same time, the court reduced the overall award to $13,233, ruling that while the city of Akron was legally wrong to withhold the records of the girl's rape, it nevertheless acted reasonably in protecting the records, the unbylined newspaper article reported.
