Beyond Plame: Court Paves Way for Journo Testimony in Wen Ho Lee Case

By: E&P Staff While the Plame case continues to draw most attention, a federal appeals court has refused to block an order requiring four journalists to testify about their sources in the case involving former nuclear scientist Wen Ho Lee.

The appeal failed on a 4 to 4 vote on Wednesday, with the result released Thursday.

The four reporters are: Robert Drogin of the Los Angeles Times, H. Josef Hebert of the Associated Press, James Risen of the New York Times, and Pierre Thomas, formerly of CNN.

Two of those judges who dissented cited First Amendment threats.

The case goes back to 1999, with reports that Lee, who worked at Los Alamos National Laboratory, was a suspect in the theft of nuclear secrets by China, but most charges were later dropped. Lee is suing government agencies for allegedly violating the Privacy Act by leaking information to the media.
