Court Allows QIPC Sales During Infringement Trial

By: E&P Staff The United States District Court for the Eastern District of Pennsylvania ruled this week that sales by Q.I. Press Controls (QIPC) are not to be restricted during a patent-infringement trial.

The case, for which no trial date has been set, arose from last June's complaint by Quad/Graphics subsidiary QuadTech Inc. that QIPC's markless register control (mRC) infringes QuadTech's U.S. Patent 5,412,577 from 1992 in both mark and markless mode.

A year before QuadTech filed its U.S. suit, a district court in D?sseldorf found QIPC had infringed a related patent in Germany and enjoined QIPC from selling its mRC in that country -- a ruling upheld on appeal several months later.

QuadTech, Sussex, Wis., offers its own Register Guidance System with MultiCam. Former QuadTech employees founded Q.I. Press Controls, a Dutch company with offices in North Kingstown, R.I.
