Japanese Government Backs TKS Appeal

By: E&P Staff The U.S. Court of Appeals for the 8th Circuit has recorded a petition by Tokyo Kikai Seisakusho for a rehearing, before the full court in St. Louis, of its initial appeal of the outcome of Goss International's antidumping lawsuit.

The Government of Japan has filed a friend-of-the-court brief on behalf TKS's petition.

Goss brought the suit in 2000 against several competitors, all of which except TKS settled before trial. Goss won the suit in late 2003 and was awarded more than $31.5 million in damages and almost $3.5 million in attorney fees in 2004. Last month, TKS lost its initial appeal of that suit before three 8th Circuit judges sitting in Cedar Rapids.

In the meantime, Goss has moved for recovery of attorney fees of more than $1.28 million, as well as costs.
