Judge Asks if Prosecutor Reported Subpoenas For Newspaper Records

By: A judge is pressing the Maricopa County Attorney's office to disclose whether a former special prosecutor made required reports about subpoenas issued to a newspaper and its staffers.

Presiding Criminal Judge Anna Baca says the normally secret grand jury file has no documents indicating that required disclosures were made about since-revoked subpoenas to Phoenix New Times.

State law requires that the presiding judge and grand jury foreman be notified when a court clerk issues subpoenas on behalf of prosecutors.

Two top New Times executives were arrested after they reported on the subpoenas demanding information on stories about Sheriff Joe Arpaio and also information about New Times' online readers. Charges have been dropped in the case.
