Judge Clears Nashua Daily in Malice Lawsuit

By: A New Hampshire judge has ruled The Telegraph newspaper was not acting in malice when it published a news story describing the long criminal history of a man arrested in Hudson in 1999.

Superior Court Judge William Groff said the Nashua newspaper published the article in good faith, had the public's interest in mind and conducted extensive research in reporting on the arrest of Terry Thomas. The judge ruled that because The Telegraph followed those standards and published the statements of police officers who had a legal privilege to discuss Thomas' arrest and criminal history, the newspaper did not commit malice.

Thomas was arrested on a stolen property charge. The newspaper quoted police in both states and court records that connected him to 1,000 crimes in the previous 19 years.
