Judge Refuses to Toss Warren Beatty Lawsuit Over Rights to 'Dick Tracy'

By: E&P Staff A federal judge has refused to dismiss Warren Beatty's lawsuit against Tribune Co. over the rights to comic strip detective "Dick Tracy."

At the same time, U.S. District Court Judge Dean D. Pregerson refused a request by Beatty's attorneys to sanction Tribune for seeking the summary dismissal.

The decision, first reported in Variety by Ted Johnson, keeps the long-running battle between Beatty, who directed and starred in the 1990 film "Dick Tracy," and Tribune.

Tribune notified Beatty on Nov. 20, 2006 that it would take back his ownership rights to the character unless he began production on a new "Dick Tracy" project within the next two years. According to the Variety account, Beatty argues that he started principal photography on a television special Nov. 8, 2008. Tribune contends it still has the right to take back Beatty's rights to the character.
