By: Jennifer Saba The attorney representing 10 advertisers that sued Newsday in the current circulation scandal claims that the paper is trying to make an "end run" at his clients. Joseph Giaimo told E&P on Friday that the Melville, N.Y.-based newspaper has been making settlement overtures to individual clients without his involvement, essentially trying to break up the class-action suit.
Calls to Newsday for comment were not returned by Friday afternoon.
Giaimo said that he was due in court on Monday to ask the judge to stop Newsday from contacting his clients. An order from the U.S. District Court, Eastern District of New York, advised both plaintiffs and defendants to appear for a conference today at 10 a.m.
Giaimo claims it's unfair for Newsday to try and settle without his knowledge since his clients may not know how much they are entitled to. The advertisers are suing Newsday for $100 million.
