Maryland Governor Seeks Dismissal of 'Sun' Lawsuit

By: (AP) Attorneys for Maryland Governor Robert Ehrlich have asked a federal court to dismiss a lawsuit filed by The (Baltimore) Sun over the governor's ban of state employees from speaking with two writers at the newspaper.

The motion to dismiss was filed by Maryland Attorney General Joseph Curran.

The motion says the Sun didn't demonstrate in its lawsuit how the ban violates the First Amendment.

It says the newspaper is asserting that two of its employees have a constitutional right to have state employees return telephone calls.

Ehrlich met with Sun executives on Dec. 17, and both sides said they had made progress toward a resolution.
