NBA SUES NY TIMES OVER PHOTOS

The National Basketball Association has sued The New York Times Co. for
selling five photographs from the 1999 N.B.A. playoffs, the newspaper
reported Tuesday.


The N.B.A.'s lawsuit, filed in New York State Supreme Court, argues that the
sale was a breach-of-contract. The contract on the back of press passes
stipulates the newspaper's use of photographs is limited to 'news coverage.'


The professional basketball league has its own photographers to take pictures
of games that are later sold through N.B.A. outlets. However, media
organizations, including the Times, often resell photographs from
various events for news and syndication.


The press passes issued by the N.B.A. said 'the use of any photograph, film,
tape or drawing of the game, player interviews or other arena activities taken
or made by the accredited organization of the individual for whom this
credential has been issued shall be limited to news coverage of the game.'
