Nevada ACLU Wants Judge Removed from 'Las Vegas Review-Journal' Case

By: The American Civil Liberties Union of Nevada wants U.S. District Judge Kent Dawson removed from a case about whether comments posted on a newspaper Web site threatened violence to jurors and prosecutors in a criminal tax trial.

The ACLU filed court documents Monday claiming Dawson might favor the government in the subpoena case because he got federal Marshals Service protection during the 2005 trial of convicted tax rebel and author Irwin Schiff.

Schiff and co-defendant Cynthia Neun were convicted in October 2005 of conspiracy, tax evasion and tax fraud and sentenced to federal prison.

The ACLU is fighting a government subpoena seeking information from the Las Vegas Review-Journal about the identity of two people who posted comments about the tax trial of Las Vegas business owner Robert Kahre.
