Q.I. Press Controls, Oosterhout, The Netherlands, has responded to the latest lawsuit filed against it by Quad/Tech, Sussex, Wisc., in U.S. District Court for the Northern District of California, in which Quad/Tech claims that QIPC's Intelligent Density System infringes QuadTech's U.S. patent covering positioning of an imaging device.
Quad/Tech earlier launched similar litigation in Germany, where it won, and a year later in a U.S. District Court in Pennsylvania, where the case has not yet been heard.
According to QIPC, the new case filed in the new jurisdiction makes infringement allegations that the federal judge in Pennsylvania already rejected. It noted the judge there did not allow Quad/Tech to amend its complaint to include infringement claims related to QIPC's Intelligent Density System (IDS).
The patent at issue, according to QIPC, relates to a color registration system, whereas the IDS is a color density system.
Quad/Tech appealed the ruling in Pennsylvania to the Federal Circuit Court of Appeals in Washington, D.C., and the case has been stayed.
QIPC said it "will address Quad/Tech's latest tactic in court" and that it believes the decisions already made by a federal judge are "the first step toward QI's total vindication."
The company maintains that neither its register-control products sold in the United States nor its IDS infringe Quad/Tech's patent.
