Seyfarth Shaw has created a checklist to help employers with 100 or more employees achieve compliance with the OSHA COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS).
Pending legal challenges have called into question the viability of ETS, published in the Federal Register on Nov. 5, and the Fifth Circuit has stayed the ETS. However, Seyfarth Shaw is encouraging employers to move toward complying with the ETS requirements. The ETS includes two compliance dates, Dec. 6, 2021, which includes most of the obligations mandated under the standard, and Jan. 4, 2022, which primarily addresses testing.
