Student Photojournalist Who Witnessed Murder Can Keep Photos, Under Shield Law

By: A judge has ruled that a student photojournalist who witnessed a murder on a San Francisco street doesn't have to turn over his photos to police.

The judge ordered police Wednesday to return photos seized from the San Francisco State University student's apartment. The man was with 21-year-old Norris Bennett at the time of the April 17 shooting to collect material for a project on life in the Bayview district.

The judge ruled in favor of the student, saying he's covered by California's shield law, which lets journalists maintain the confidentiality of their sources and keep unpublished material from police.

The student's attorney says his client was a freelancer, which also are protected under the shield law.

No one has been arrested in Bennett's death.
