Terry Nichols' Brother Also Back in the News -- in Case Against Michael Moore

By: E&P Staff The revelation in The Oklahoman newspaper Sunday that Terry Nichols had finally admitted his part in Timothy McVeigh's 1995 terror bombing in Oklahoma City came just as his brother's case against filmmaker Michael Moore resurfaced.

Moore's lawyer, Herschel Fink, who is defending him against a libel suit over his film "Bowling for Columbine," called on the judge to dismiss the "frivolous" and "silly" claims of Nichols' brother. He claims Moore's film unfairly accused him of involvement with the bombing that killed 168 people.

James Nichols's attorney said Moore's claims that he was arrested in connection with the attack were untrue, because Nichols was only ever held as a "material witness" by police. They also question the film's suggestion that investigators dropped charges against him because they couldn't get "the goods" on him and say most viewers will believe that Nichols was involved in the bombing but somehow escaped prosecution.

But Moore's lawyer said the film only reported the truth and that he had a right to his constitutionally protected opinion. The assertions were based on court documents and news items from reliable media sources. "When you see a Michael Moore film, you know it's opinion," he said. "And it's protected."

Nichols's brother Terry is currently serving two life sentences without parole for his part in the attack. According to the Oklahoman, he started speaking to the FBI about his role in April at a federal prison in Florence, Colo. Nichols, 50, made similar disclosures to his mother, sister and first ex-wife last month, the newspaper said.
