Judge Orders Judith Miller to Testify

By: E&P Staff A federal judge has ruled that star New York Times reporter Judith Miller must testify before a grand jury as part of a federal probe into the disclosure of CIA officer Valerie Plame's name.

In a decision made public Thursday, U.S. District Judge Thomas F. Hogan rejected Miller's claim that as a reporter she should not be compelled to testify about confidential sources.

Hogan said Miller's testimony "is necessary for completion of this investigation ... and is expected to constitute direct evidence of innocence or guilt."

This was consistent with his earlier rulings. In recent weeks, Hogan had rejected claims that the First Amendment protected several other journalists involved in this case from subpoenas.
