By: The Boston Herald has asked the state's highest court to reconsider its ruling that confirmed a two million-dollar libel verdict won by a Superior Court judge.
On May 7, the state Supreme Judicial Court affirmed a 2005 judgment against the newspaper.
A jury found the Herald and reporter David Wedge had libeled Judge Ernest Murphy in a series of articles.
Murphy claimed a Herald reporter misquoted him as asking lawyers involved in a rape case to tell the 14-year-old victim to "get over it."
Herald Editor Kevin Convey said today (Monday) that they are asking the court to reconsider its decision, arguing they believe judges made several errors in their consideration, and their analyis is flawed.
In its original appeal, the Herald said Wedge did everything he could to ensure the stories were accurate, including twice trying to get comment from the judge himself.
Murphy's lawyers said Wedge got numerous details of the story wrong and that he depicted Murphy as a heartless judge who demeaned the rape victim.
